Mr. Pitcaithley has handled multiple catastrophic injury cases during his long professional career.  In
these high-profile cases, the injuries almost always include life changing permanent disabilities, such as paraplegia, loss of limb, brain injury, chronic nerve disruption, chronic lifetime pain, and permanent disability restricting the ability to walk normally, or prevent free movement in the head, neck and whole spine.  These special cases require a life care planning expert witness to create a detailed medical plan (and the cost of the future medical treatment) for the duration of the catastrophically injured party’s life or life expectancy. The injured party’s future anticipated medical bills, depending on the age of the injured party, can reach into the millions of dollars. The past  wage loss and the cost of future employment re-training also results in a substantial damages that often reaches into the  millions of dollars. 

These catastrophic injury cases require both liability and damage expert witnesses, sometimes as many as 6-10 separate experts.  The litigation costs alone (for expert witnesses such as accident reconstruction / biomechanical engineers, 3D modeling for computer animation, multiple medical specialists/doctors, life care planners, day in the life video production, and economists) – to take these cases through a trial –  can be as much or more than $500,000.  These are the kinds of “high value” cases – because of the egregious nature of the negligent act and/or the permanent nature of the injuries involved – that most often end up going to trial.

To spread the financial risk of the litigation around, and even more importantly, to associate trial counsel with proven expertise in the precise type of case involved (such as a government tort claim for example), Mr. Pitcaithley will enter into an association of counsel or referral partnership with another trial attorney and the trial attorney’s firm (a complete team of lawyers).  This significantly enhances the injured party’s ability for financial success through trial, by allowing Mr. Pitcaithley to build a “dream team” for his client’s case.

Building the “dream team” in this way does not increase the contingency fees paid by the injured party as Mr. Pitcaithley and the newly associated trial lawyers agree to share in the contingency fees already set out in the injured party’s fee agreement with Mr. Pitcaithley.  Yet, this strategy allows Mr. Pitcaithley to build a dream team of trial lawyers for the specific case in which the client was catastrophically injured. It’s a win-win situation for the client and this has been proven time and again in the cases where this strategy has been used (see Settlements And Verdicts Pages).  This association of counsel and/or referral partnership complies in every respect with California Business and Professions Code and the California Rules of Professional Conduct.
